Raila files fresh application

Prime Minister Raila Odinga has filed a fresh application at the Supreme Court under certificate of urgency in which he wants the Independent Electoral and Boundaries Commission’s failed electronic system audited in its entirety.

In the petition filed on Monday, Raila also wants IEBC compelled to produce all its records on the systems to enable the country’s most superior court conduct the audit.

This even as IEBC, in its response to the petition filed at the Supreme Court on Monday, described the CORD petition as that which is devoid of substance in law and in fact.

The response which was signed by the beleaguered IEBC Chairman Isack Hassan was quick to defend the procurement process of the electronic equipment that terribly failed during the just concluded elections.

In what appeared like shifting blame, Isack says the government of Kenya through the office of the petitioner and the treasury played a role in the acquisition of the equipment being disowned.

In the two volume response, Isack submits that the last election was in fact free and fair, adding that the President elect attained 50+1 of the votes cast before being declared the winner of the last election, as stipulated by article 138 of the constitution.

He concludes by saying claims made by the petitioner on the contrary are devoid of evidentiary basis.

The CORD coalition on the other hand claims it won the election, were it not for what it says were glaring irregularities witnessed among other things in the tallying process.
