Justice and Constitutional Affairs Minister Mutula Kilonzo says his ministry is embarking on immediate process of adopting a judicial mechanism to try perpetrators of post election violence as one of the agreed modalities with the ICC prosecutor Louis Moreno Ocampo.

Mutula said it was difficult to beat the September deadline of establishing a special tribunal .

"The other report to be presented to the prosecutor is on the safety of the victims and witnesses , he said.

The minister hinted that he will present proposal in parliament, adding that he was not tied to the provision in the Waki report which only wanted a local tribunal.

Speaking in Naivasha, he said: "The Hague option is being fuelled by scepticism."

He warned those opposed to the local tribunal saying they should not expect to have an easy time at The Hague, adding that Kenya will not accept offences against humanity.

During the meeting with Ocampo, it was agreed that the government would employ all judicial mechanisms with the help of parliament to deal with perpetrators of of the poll chaos.

ICC

Mutula said Kenya supported the Rome statute that establishes ICC adding he will be providing him with modalities for conducting national investigations and prosecutions of those mentioned in the Waki list.

According to the minutes of the meeting at the Hague, if there is no agreement from Parliament, the government will have no choice but refer the matter to ICC in accordance with Article 14 of the Rome Statute.

Among those who accompanied Mutula to The Hague include Attorney General Amos Wako, and Lands Minister James Orengo.
