ODM now says it will cooperate with the International Criminal Court when it commences investigations in Kenya over the post election violence.
Addressing a press conference Tuesday after the Party's NEC meeting, party chairman Henry Kosgey however clarified that ODM is not party to Moreno Ocampo's trip to the country later this week saying his mission only involves the government.
"We support the position taken by the two principals and we will cooperate with Ocampo since Kenya is a signatory to Rome statute" said Kosgey .
Ocampo who arrives in the country on Thursday is expected to meet President Mwai Kibaki and Prime Minister Raila Odinga, on dealing with post-election violence suspects
At the same time, ODM expressed concern over the delay in disbursing Sh200 million allocated to political parties to fund their operations.
Kosgey said the party will be seeking audience with the registrar of political parties this week over the issues.
Local tribunal
Elsewhere, plans have been put place to enable victims of the post election violence in Eldoret present a petition to Ocampo.
Civil Socity groups in Eldoret have been carrying out sensitization programmes for the victims to enable them give their story to the prosecutor which climaxed with the arrival of former MP Kabete MP Paul Muite.
Addressing the victims in Eldoret, Muite said a number of the victims from the area which was the epicenter of the violence will be assisted to travel to Nairobi and join their counterparts so that they can present their petition to the ICC prosecutor.
Saying that all communities suffered in the violence, the former MP called on the victims to unite in demanding for justice for the perpetrators of the violence saying they should not allow leaders to divide them along tribal lines as has always been the case saying any leader implicated should carry his or her own cross.
Muite said while he supported forgiveness, it was important that forgiveness goes hand in hand with justice saying the victims and the aggressors should come face to face and forgive each other.
"There was need for the establishment of a local tribunal and called on MP's to support the bill when parliament reopens to allow for the trial of other offenders saying the ICC can only deal with 5 people at most".
