Case against NTSA DG to be heard in June

Justice Byram Ongaya of the Employment and Labour Relations Court has directed a case involving an applicant Versus National Transport and Safety Authority (NTSA) Director General and Ministry of Roads and Transport be heard by all parties on 11th June, 2024.

The Judge while giving the directions virtually Thursday told the Petitioner to serve his application to National Transport and Safety Authority and Ministry of Roads and Transport within a period of seven days.

The aggrieved Petitioner Edwin Oduor seeks to stop the extension of National Transport and Safety Authority (NTSA) Director General George Njao who has sought to have tenure of office extended. The court was told the appointment of Mr. Njao was not competitive and intended extension should be stopped by the court.

The petitioner had claimed Njao has not delivered during his three-year tenure as director general and that there was deliberate mismanagement and delinquency that occasioned the deaths of thousands of Kenyans through road carnage, which could have been avoided if he offered proper leadership.

In February this year, Oduor told Employment and Labour Relations Judge Byram Ongaya that he did not consent to an order of settling the matter out of court.

The consent was allegedly adopted by the court in January 2023.

Were wants the matter reinstated saying the adoption of the consent by the court was made without his approval. The advocates who drew the consent did not join the court proceedings virtually when the directions were given.

In a quick rejoinder, the NTSA board through Advocate Charles Agwara told the court that the adoption of the consent only meant that the matter had been settled and there was nothing left for the court to determine.

Njao has served from 2019 when he was appointed for a term of three years.In the case, the board of directors NTSA is listed as the first respondent, while the Transport Cabinet Secretary is the second respondent.
