A Dutch National and two Kenyans have been acquitted of murder after a Malindi Court found there was no evidence linking them to the brutal killing of a Kenyan married to a German national six years ago.
Emericus Hendricus Van Werf his wife Vera Juliet Anyango who claimed to be proprietors of Sailfish Club and Said Abdalla Kadenge a manager at the hotel had been charged with the murder of Lilian Mwikali Andree on November 14, 2012.
Lilian Mwikali Andree had allegedly come to repossess Sailfish Club formerly known as Big Game Fishing club hotel, which she claimed belonged to her husband.
However her body was found stuffed in a septic tank at the Sailfish club on November 14, 2012.
Emericus Hendricus Van Werf his wife Vera Juliet Anyango and the hotel manager Said Abdalla Kadenge were arrested and charged for her murder.
While delivering the acquittal judgment at the Malindi High Court on Wednesday Justice Weldon Korir said the prosecution’s case was anchored on circumstantial evidence.
Justice Korir said in order to obtain a conviction in a case of murder the prosecution should establish malice after thought as defined in section 206 of the penal code.
Emericus maintained that he was the owner of Sail fishing club adding that he was still fighting to get back his property.
