Senate Speaker notified on impeachment of Nyeri Governor

Senate Speaker Ekwe Ethuro Monday morning received communication from Nyeri County Speaker David Mugo notifying him of the decision of the County Assembly to impeach Governor Nderitu Gachagua.

32 Members of the County Assembly of Nyeri voted to impeach Governor Nderitu Gachagua after months of altercations and confrontations.

And in line with section 33 of the County Governments Act, that requires County Speakers to notify Senate Speaker of the decision within two days, Ekwe received communication from Nyeri County Speaker.

The Senate Speaker shall within seven days convene a sitting of the Senate to hear the charges leveled against the Governor.

The Senate may appoint a special committee comprising 11 members to investigate the charges and report back to the Senate within 10 days.

Sources close to him indicate that Gachagua contemplates seeking redress in court arguing that his impeachment was unconstitutional since the County Assembly didn’t give him a chance to defend himself.

The Governor shall have the right to appear in person or be represented before the committee.

Last week,  32 out of 47members of the county assembly voted to impeach the governor in the motion moved by Kiganjo Ward MCA, Baragu Mutahi, which lasted close to five hours after members sought for extension of time to make their contributions.

The ward representatives accused the county boss of alleged misconduct and gross violation of the constitution.

Among the accusations leveled against Gachagua, is a discrepancy in a report by the controller of budget that indicates some 846 million shillings from last financial year could not be accounted for.

The governor they said had committed a number of sins to the people of Nyeri which included failure to assent to the county’s 6.4 billion shillings budget for this financial year after the MCAs hived off  40 million that has been set aside for his luxury car and foreign travels.

The MCA s were seeing this as a retaliatory move after the governor declined to approve 75 million-health club for the county assembly consisting gym, sauna and massage rooms and sauna.
