Susan Kihika is now back in the race for the Nakuru Senatorial race after the high court overturned a decision by the Political Parties Dispute Tribunal that nullified her nomination as the Jubilee candidate.
Justice George Odunga ruled that the political parties’ dispute tribunal does not have the jurisdiction to hear and determine matters as regards the interpretation of the constitution.
Kihika had moved to the high court to challenge the PPDT decision to bar her from contesting for the senatorial seat over allegations that she did not resign from her position as Speaker of Nakuru county assembly on time as required by law.
The tribunal chaired by Kyalo Mbobu ruled that Kihika was ineligible for the August 8 poll as she is still in office as the Speaker of Nakuru County Assembly contrary to article 99 of the Constitution which states that a candidate who is still a member of the county assembly cannot vie for MP before resigning.
