The High Court has temporarily suspended the expulsion of nominated Senator Gloria Orwoba from the United Democratic Alliance (UDA) pending the hearing and determination of her application.
Justice Lawrence Mugambi issued the orders on Wednesday after reviewing a Notice of Motion and a supporting affidavit sworn by Orwoba on May 20.
The court also halted her removal as a nominated senator.
“That pending hearing and determination of this application, a conservatory order is hereby issued suspending the implementation of the decision of the UDA Party Disciplinary Committee dated 16/05/2025 expelling the petitioner herein as a member of the UDA Party and/or a nominated senator,” the ruling stated.
The development comes just hours after Senate Speaker Amason Kingi issued a gazette notice declaring Orwoba’s seat vacant.
“It is notified for the general information of the public that pursuant to Article 101(2) of the Constitution of Kenya, a seat of the member of the Senate elected under Article 98(1)(b) of the Constitution, held by Gloria Orwoba, has become vacant with effect from 21st May, 2025,” read the gazette notice.
Orwoba was expelled from the ruling party over allegations of disloyalty and violation of party ideals. The party questioned her participation in the homecoming ceremony for former Interior Cabinet Secretary Fred Matiang’i at Gusii Stadium, terming it a breach of the party’s Code of Conduct.
UDA has already nominated Consolata Wabwire Wakwabubi from Kimilili, Bungoma County, to replace Senator Orwoba.
The case will be mentioned on June 3, 2025 for further directions.
