Notice given to auction disputed wheat was short, Beyond Auctioneers tell court

The Multi billion shilling grain suit pitting Atta Kenya limited and Grain bulk handlers limited entered homestretch Thursday with one defendant witness from Beyond Auctioneers taking to the stand.

The witness was at pain to explain who gave the auctioneers the go ahead to have the disputed wheat auctioned.

 

The cross examination of the second last witness began with the Atta Limited lawyer Mila Bwire questioning the Beyond Auctioneers witness whether the notice to collect and sell the thirteen thousand metric tons of wheat was properly done.

 

Bwire told the court that the process of disposing off the disputed wheat was done in bad faith and against the laid auctioning procedures.

 

The auctioneer in his response said that the notice issued to auction the wheat was too short saying more time was needed.

 

The lawyer went further to nudge the auctioneer to verify the amount he had auctioned and if he had any proof to it yet again the auctioneer failed the test.

 

In some instances, Atta Kenya limited had to seek the intervention of the magistrates and the defendants lawyer to have the witness answer the questions as required.

 

The cross examination came to an end with the High Court Judge Florence Macharia saying there was a pending application of the same case that had to be given.

 

She directed to have the ruling of the application on the 11th of April 2024.
