Court rules that KBC is a lawful beneficial owner of Komarock Transmission land

Kenya Broadcasting Corporation (KBC) has secured a decisive court victory in a long-running land dispute after the Environment and Land Court in Machakos ruled that the broadcaster is the lawful beneficial owner of more than 500 hectares of land in Komarock, Machakos County, where its transmission station is located.

In a judgment delivered on 17th December 2025, the court found that the parcel, situated along Kangundo Road, was lawfully acquired by the Government of Kenya through compulsory acquisition for public broadcasting purposes, and that the original owner, Komarock Ranching and Farming Co-operative Society Limited, was duly and fully compensated. 

The Court declared that KBC holds the land as a trustee of the Government of Kenya, issued a permanent injunction barring the cooperative and its agents from entering, subdividing, disposing of, or interfering with the property, and awarded general damages of Ksh million for trespass, alongside costs of the suit.

The ruling brings to a close a case first filed in 2013, in which KBC accused the cooperative of illegally trespassing and attempting to subdivide the land, threatening critical national broadcasting infrastructure.
