Labour court reinstates ICT Authority chief executive sent on leave

The Employment and Labour Relations Court has reinstated Stanley Kamanguya as the ICT Authority Chief Executive Officer until a petition filed is heard and determined.

Kamanguya filed an urgent application contesting the decision by ICT Authority chairperson to send him on terminal leave and advertise the vacant position as the authority commenced search for his replacement.

The interim Conservatory Order by Justice Mathews Nderi Nduma has also restrained the authority’s board from from considering any new application for the position which it had declared vacant through an advertisement on ICTA website.

The court has also barred acting CEO Zilper Owiti from assuming the role until the case is heard and determined.

“Pending the inter-partes hearing and determination of the Petition herewith interim Conservatory Order is hereby issued restraining the Proposed Interested Party herein – Zilpher A. Owiti – from executing any functions reserved for the Chief Executive Officer of the 1st Respondent and directing the 1st Respondent to grant the Petitioner unrestricted access to office,” ordered Justice Nduma.

On July 7 this year, ICT Authority placed Kamanguya on terminal leave and appointed Owiti to assume the role in an acting capacity with immediate effect.

“The Board of Management of the ICT Authority wishes to notify the Public of the Appointment of Ms. Zilpher Owiti as the Acting Chief Executive officer. Ms Zilpher replaces Mr. Stanley Kamanguya who has proceeded on terminal leave effective 1 July 2025,” read the notice by the Authority.

The court has further issued a summons to ICT Authority Chairperson Lily Ng’ok for contravening two court orders issued an prohibiting discussions on Kamanguya’s reappointment.

“Summons is issued to the 2nd Respondent to show cause why she should not be punished for Contempt of the Orders of this Honourable Court issued on 24th June, 2025 and further orders issued on 7th July, 2025,” stated Justice Nduma.

The application be served and it be responded to within 14 days of service with interpartes hearing set for September 29,  2025.
