The Ethics and Anti-Corruption Commission (EACC) has obtained court orders stopping the Kiambu County Government from making a payment of Ksh166,295,500 to a company that was allegedly awarded a tender irregularly.
According to the commission, Filtronic International Limited is alleged to have irregularly and fraudulently secured a tender for the development, installation, testing, training, commissioning and support services of an Enterprise Resource Planning System (ERP) from the County.
The EACC, following an inquiry into alleged procurement irregularities, found that in March 2023, the County Government advertised an invitation for bids with a set deadline for submissions, yet only Filtronic submitted.
In its bid, the company is accused of submitting financial statements for 2020, 2021, and 2022 that were purportedly audited, although the EACC maintains that no such audits were ever conducted.
The company’s bank statements were also allegedly altered to depict a positive cash flow. “However, the Commission’s investigations established that the bank statements provided Filtronic’s bid document were fraudulently and illegally edited to depict a purportedly healthy cash flow and profitability”, EACC revealed.
The investigation further established that two individuals named in the bid documents were not employees of the company.
On 24th February 2024, contrary to the provisions of Section 139 (2A) of the Public Procurement and Asset Disposal Act, the Chief Officer Revenue, Supply Chain Management, ICT & Internal Audit, illegally and irregularly signed the extension of the contract agreement.
The company allegedly received Ksh63,704,500, leading the EACC last week to file legal proceedings to recover the funds and secure a permanent injunction restraining the Kiambu County Government from releasing the remaining contract amount.
The application shall come up for inter-parties hearing on the 13th of November 2025.
