High Court halts impeachment of Kericho Governor Eric Mutai

The High Court in Kericho has stopped the planned impeachment of Governor Eric Mutai.

In interim orders issued by Justice Joseph Sergon, the court barred Kericho MCAs from debating or considering the impeachment motion seeking to remove the governor from office, pending the hearing and determination of the case.

“Pending the inter partes hearing of the motion dated 1/10/2024, interim conservatory orders are issued against the respondents jointly and severally, suspending and staying the debate, consideration, or any action on the notice tabled on 23/09/2024 and the motion moved on 24/09/2024 for the removal of the applicant-governor from office,” the ruling reads.

The court further directed that the parties involved file and exchange written submissions within 10 days from the date of service of the respondents’ responses.

Respondents in the case include the County Assembly of Kericho, the Speaker of the County Assembly, and Sigowet Ward MCA Weldon Rogony, who is the mover of the motion.

On September 24, Rogony filed a motion to impeach Governor Mutai, citing gross violations of the Constitution, various national and county laws, and abuse of office.

He also accused Mutai of misappropriating and abetting the misappropriation of public funds.

Other allegations include illegal appointments, unlawful dismissals and transfers, and the usurpation of the constitutional and statutory functions of the County Public Service.

Other accusations are bullying, incitement, vilification and indecent sexual conduct.

A total of 37 out of 47 MCAs voted to remove the governor.
