Moses Dola, a former journalist, has been released by the High Court after being convicted of manslaughter in connection with the death of his wife.
He was found guilty of killing his wife, Sarah Wambui Kabiru, a former NTV reporter, in 2011 at their Umoja home in Nairobi.
High Court Judge Justice Alexander Muteti allowed Dola’s application for review and ordered the prison department to release him with immediate effect, stating that the time spent in custody, combined with the time he had been imprisoned, amounted to 10 years unless held legally on other legal grounds.
Dola, who has already enrolled at the Kenya School of Law, thanked the judge for granting his application and expressed his desire to appear before the judge once he completes law school.
He was initially charged with murder, which was later reduced to manslaughter and subsequently sentenced to 10 years in prison in 2018.
Dola had filed an application requesting the court to take into account the lengthy period (23 months) he spent in custody before the case was considered.
After the incident on May 1, 2011, he went into hiding, but he turned himself in at Naivasha Police Station three days later.
In the ruling, High Court Judge Roselyn Korir noted that there is no one who could say exactly what happened to Kabiru on that fateful day because they were the only ones in the bedroom when the incident occurred.
She, however, ruled that the evidence tabled showed that Dola caused the death of his wife.
