Couple charged with Ksh. 177 Million in tax evasion in Eldoret

A couple, both of whom are company directors, has been charged in the Eldoret Law Courts with tax fraud amounting to Ksh. 177 million.

Wilfred Karongo Njoroge and Rosemary Wanjiru Wanjiku, both directors of Wa Morgan Wholesalers Limited, jointly faced seven counts of tax fraud-related charges. They were charged with four counts of failure to pay both income tax and Value Added Tax (VAT) for 2023 and 2024, totalling Kshs. 63,863,512. They also faced two counts of failure to submit tax returns for the same period and an additional count of failure to register for VAT.

Karongo, separately, faced eleven counts of tax fraud, which included failure to pay taxes amounting to Kshs. 113,393,043 in both income tax and VAT. He was charged with ten counts of failure to pay taxes by knowingly omitting to declare income chargeable to both income tax and VAT. He also faced additional counts of failure to register for VAT while dealing with vatable supplies, as required under the law.

The accused persons appeared on Friday before Senior Resident Magistrate Kyene Odhiambo Gweno, where they denied all the charges and were released on a bond of Kshs. 10 million, with an alternative cash bail of Kshs. 1 million.The case will be mentioned on 14th April 2025. If found guilty, the accused will be sentenced to a fine double the tax evaded or imprisonment for a term not exceeding 5 years, as provided for by the Tax Procedure Act, 2015.
