Counties receive Ksh 3.6B for roads maintenance after court directive

County governments have received the first payment under the Road Maintenance Levy Fund (RMLF) amounting to Ksh 3.68 billion following High Court ruling in June this year.

The disbursement which covers 2024/25 financial year is equivalent to 35pc of Ksh 10.52 billion counties were demanding from the national government as part of conditional grants for maintenance of roads within their jurisdiction.

“County Governments are required to submit detailed work plan for the amount released to respective KRB Regional Offices in Kisumu, Nyeri, Garissa, Eldoret, Isiolo, Nakuru, Kakamega and Machakos by Tuesday 12th August 2025,” said the board.

In the latest disbursement Nakuru County will received  the largest allocation amounting to Ksh 183 million, followed by Kitui and Makueni counties with Ksh 152 million and 146.9 million respectively.

The 47 devolved units had contested two decisions by the National Assembly made in September 2023 and August 2024 removing counties as beneficiaries of the fund before getting reprieve from the High Court in Nairobi.

According to the court, action by members of parliament were unconstitutional as they amounted to threat to undermine devolution by violating Article 10,118, 186 and Section 18 of Part 1 of Fourth Schedule of the Constitution.
